JOLIET, IL — The family of a 76-year-old man from Wisconsin stabbed to death inside the Joliet Harrah's Casino hotel has filed a negligence lawsuit against Caesar's Entertainment and Harrah's, Joliet, seeking a Will County jury award of at least $5 million in damages.

A transient who lived in several states prior to arriving in Joliet, Robert Watson, remains in the Will County Jail charged with the first-degree murder of Emanuel 'Sam' Burgarino.

Denise Dixon, the homicide victim's fiance, filed the lawsuit at the Will County Courthouse.

She and Burgarino arrived in Joliet on March 22, 2019, and planned to stay at the Harrah's Casino hotel until Monday, March 25, 2019. Harrah's staff assigned them a room on the fifth floor of the hotel, and they got electronic key cards for their room, court records show.

Harrah's has a casino, a hotel and several restaurants all under one roof, the lawsuit stated.

'Harrah's Joliet gives the impression that there are security cameras throughout the structure and that a security team is monitoring those cameras and protecting hotel guests,' the plaintiff's lawsuit outlined.

That Sunday evening, Burgarino and Dixon were gambling in the Joliet casino, and the Wisconsin man went back to his hotel room to retrieve something between 9 and 10 p.m., court records show. He went by himself, using the elevator, and walked to his fifth floor room.

The 76-year-old Hales Corners resident was attacked between the elevator and his room. At 9:47 p.m., Watson assaulted him, stabbed him multiple times, as Watson robbed him of his money, court documents indicate.

Watson ran down a stairwell and left the hotel. He was captured the following afternoon about a block away inside the Joliet Public Library,Joliet Patch has previously reported.

'Watson was not a guest of the hotel, and he had not been issued an electronic key card or assigned a room,' Northbrook attorney Jeffrey Crane stated in the lawsuit. 'Watson had been stalking patrons in the casino before the assault in plain view of the hotel staff. Watson had appeared several times on the security cameras in the hotel section of the Harrah's Joliet casino in the hours and over the weekend prior to the assault.

'Although Watson exhibited suspicious behavior, the defendants did not investigate why he was on the premises or prevent him from assaulting Sam.'

The lawsuit also explains: 'Watson was able to walk by both security cameras and the hotel reception desk, and without an electronic key card, ride the hotel elevator to the fifth floor where he committed the fatal assault.'

Watson has a criminal history in Illinois, Arizona, Texas and Wisconsin for crimes including burglary, robbery and aggravated robbery, the plaintiff's lawyers stated.

As for the stabbing victim, a Joliet Fire Department ambulance rushed Burgarino to the AMITA Health Saint Joseph Medical Center where he died on March 24, 2019.

The lawsuit accuses Harrah's and Caesar's Entertainment of outrageous treatment of the plaintiff 'which was motivated by their desire not to interrupt money-making activities at their casino/hotel.'

Harrah's staff made no effort to find Dixon or page her to notify her what happened to Burgarino 'and to give her the opportunity to be with him,' court records reflect. 'When Denise, wondering why Sam had not returned to the casino, went to the hotel elevator to follow Sam to their room on the fifth floor, one of the defendants' employees blocked her and told her that she could not proceed without investigating who she was or informing her that Sam had been assaulted.

'The defendants generally suppressed information that an assault had occurred in the hotel or that Watson was not apprehended and remained at large,' the lawsuit reflects.

A Joliet police officer later drove Dixon to the Joliet hospital, but by the time she got there, Burgarino had died.

Later, Dixon returned to the Harrah's casino and 'none of the defendants' employees offered Denise sympathy for what had happened to Sam. To the contrary, the clerk asked her to pay her hotel bill. To this day, the defendants continue to send Denise and Sam personalized advertising asking each of them to come back for another stay at the hotel/casino,' Dixon's lawsuit states.

The lawsuit against Caesars and the Joliet Harrah's Casino accuses the defendants of premises liability: negligence and reckless conduct.

The lawsuit asks for a judgment by a Will County jury in excess of $5 million, plus reasonable attorneys fees and any further monetary relief the court deems 'equitable and just.'
